Exhibit Return
At the conclusion of a court case and after the 40-day appeal period has expired, exhibits may be returned to the party to whom they belong or released to the party’s attorney by following the process below:
Exhibits submitted to Toledo Municipal Court after July 15, 2019
- Pursuant to the Court’s Exhibit Policy, exhibits submitted to the court after July 15, 2019, may be returned to the submitting party or to the party’s attorney through a motion to the court.
- Motion forms and instructions for e-filing can be found on the Clerk of Court's website.
- Motions filed in person must be filed with the appropriate branch of the Clerk of Court. The Criminal/Traffic Department is located on the first floor of the Toledo Municipal Court building and the Civil Department (small claims, FEDs/evictions) is located in the basement.
- If a judge approves the motion for the return of exhibits, the requesting party must make arrangements in advance to pick up exhibits. Arrangements can be made by contacting Meredith Kurucz at (419) 245-1879 or meredith.kurucz@tmcourt.org.
- An Exhibit Release Form must be signed by the party who submitted the exhibits or by the party’s attorney upon the release of the exhibits.
- Exhibits shall only be released to the party who submitted them to the court, or to the party’s attorney.
Exhibits submitted to Toledo Municipal Court before July 15, 2019 in Civil (small claims, FEDs/evictions)
- Any exhibits submitted to the court prior to July 15, 2019 can be picked up from the Clerk of Court. The Civil Department is located in the basement.
- Exhibits will only be released after final determination on a case has been made and after the appeal period has expired.
- An Exhibit Release Form must be signed by the party who submitted the exhibits or by the party’s attorney upon the release of the exhibits.
- Exhibits shall only be released to the party who submitted them to the court, or to the party’s attorney.
Exhibits will not be mailed.
In accordance with Toledo Municipal Court Rule 8.1 and the Toledo Municipal Court's Exhibit Policy, exhibits that are not claimed shall be destroyed after five years.
